TERMS OF USE

Effective Date: August 8, 2026

These Terms of Use (“Terms”) govern your access to and use of https://www.gpresets.com (the “Site”) and the digital products, content, and services offered through the Site.

The Site is operated by Greg Petersen LLC, a Tennessee limited liability company doing business as G-Presets (“G-Presets,” “we,” “us,” or “our”).

By accessing or using the Site, placing an order, or purchasing, downloading, accessing, or using a G-Presets digital product, you agree to these Terms.

If you purchase or use a G-Presets digital product, your use of that product is also subject to our End User License Agreement (“EULA”). Refunds are governed by our Refund Policy. Our collection and use of personal information is described in our Privacy Policy.

If you do not agree to these Terms, please do not use the Site or purchase or use our Products.

1. Eligibility

You must have the legal capacity to enter into a binding agreement to purchase Products from G-Presets.

If you are under the age of majority where you live, you may use the Site or purchase Products only with the involvement and authorization of a parent or legal guardian who agrees to these Terms on your behalf.

2. Digital Products

G-Presets sells downloadable and electronically delivered digital products for photographers, creators, and other users.

Our products may include, without limitation:

• Lightroom Classic, Lightroom, Adobe Camera Raw, and other editing presets;
• profiles and AI-assisted editing profiles;
• LUTs;
• tone curves and color-grading tools;
• brushes and brush packs;
• editing tools, modifiers, actions, and workflows;
• templates and configuration files;
• guides, educational materials, videos, courses, and collaboration products; and
• related digital files, documentation, and downloadable content.

Collectively, these are referred to in these Terms as the “Products.”

Products are licensed for use rather than sold as intellectual property. Purchasing a Product gives you the limited rights described in the applicable EULA or product-specific license. It does not transfer ownership of G-Presets intellectual property to you.

3. End User License Agreement

All Products are subject to the G-Presets EULA unless different license terms are expressly provided for a particular Product.

The EULA explains what you may and may not do with G-Presets Products, including rules concerning commercial photography use, multiple users, redistribution, file sharing, resale, conversion, competing products, artificial intelligence and machine learning, and other uses of our proprietary digital Products.

If product-specific license terms conflict with the general EULA, the product-specific license terms will control with respect to that Product.

4. Your Photographs and Creative Work

G-Presets does not claim ownership of photographs or other original creative works that you create or edit using our Products.

Subject to the EULA, you may use properly licensed G-Presets Products to edit photographs for yourself, your photography or creative business, and your clients.

You may commercially publish, print, display, license, sell, or deliver your finished photographs and other original creative works that you have edited using G-Presets Products.

Using a G-Presets Product to edit your photograph does not give G-Presets ownership of that photograph.

5. Orders

When you place an order, you agree that the information you provide is accurate, current, and complete.

Submitting an order does not require us to accept it. We may refuse, cancel, or limit an order where reasonably necessary, including because of:

• suspected fraud or unauthorized payment activity;
• an obvious pricing or technical error;
• misuse of promotional offers or discount codes;
• violation of these Terms or the EULA;
• suspected unauthorized resale or redistribution; or
• other legitimate legal, security, or business reasons.

If we cancel an order after successfully collecting payment and the applicable Product has not been provided, we will issue an appropriate refund.

6. Pricing, Currency, Taxes, and Payment

Product prices are those displayed at the time of checkout, subject to correction of obvious errors.

Prices may change at any time before an order is completed.

Prices may be displayed or processed in different currencies depending on your location, store settings, or payment provider. Your bank or payment provider may apply currency-conversion fees or other charges that are outside our control.

You are responsible for applicable taxes, duties, or similar governmental charges associated with your purchase except where G-Presets is required to calculate, collect, or remit those amounts.

Payments may be processed by third-party payment providers and e-commerce service providers. Those providers may apply their own terms and privacy practices to their services.

7. Digital Delivery

Products are delivered electronically.

Delivery may occur through a download page, customer account, email, third-party digital-delivery service, or another electronic method.

You are responsible for providing a valid email address and maintaining access to the email account used for your purchase.

If you do not receive or cannot access a Product you purchased, please contact us at help@gpresets.com. We will make reasonable efforts to verify your purchase and restore access.

We recommend downloading and securely backing up your purchased Products promptly after delivery.

Unless expressly promised as part of a Product, we do not guarantee that a Product will remain available for re-download indefinitely. You are encouraged to maintain an authorized backup copy of purchased downloadable files.

8. Software and Compatibility

Some Products require third-party software, applications, hardware, camera profiles, operating systems, or other technology.

You are responsible for reviewing any compatibility or system requirements disclosed on the applicable Product page before purchasing.

Unless expressly stated otherwise, G-Presets does not guarantee that a Product will remain compatible with every future version of third-party software, operating systems, cameras, hardware, or other technology.

Changes made by third-party software or technology providers are outside G-Presets’ control.

References to third-party companies, software, applications, products, or trademarks are for identification and compatibility purposes. All third-party trademarks remain the property of their respective owners. Unless expressly stated, no affiliation, sponsorship, or endorsement is implied.

9. Editing Results May Vary

Photography and editing results depend on many factors, including the original image, camera, camera profile, lens, lighting, exposure, white balance, shooting conditions, subject matter, software version, display calibration, and adjustments made by the user.

Before-and-after photographs, sample images, tutorials, testimonials, demonstrations, and other promotional materials are intended to illustrate potential results.

We do not guarantee that applying a Product to a particular photograph will produce an appearance identical to a sample image.

10. Refunds

Because Products are digital and may be delivered or made accessible immediately, purchases are subject to the G-Presets Refund Policy.

Digital Product purchases are generally final after delivery, download, or access, subject to the Refund Policy and any rights or remedies that cannot legally be waived.

If you experience a problem with your purchase, please contact help@gpresets.com so that we can investigate and, where appropriate, help resolve the issue.

Nothing in these Terms eliminates any refund, cancellation, warranty, withdrawal, or other consumer right that cannot lawfully be waived in the jurisdiction applicable to you.

11. G-Presets Intellectual Property

The Site, Products, and materials made available through them contain intellectual property owned by or licensed to G-Presets.

This may include, without limitation:

• Product files;
• preset and profile files;
• LUTs;
• tone-curve and color-grading configurations;
• brushes and brush configurations;
• editing tools and systems;
• software-related files and configurations;
• educational materials;
• course materials;
• guides and documentation;
• videos;
• graphics and illustrations;
• photographs owned or licensed by G-Presets;
• website copy and design;
• product names;
• logos;
• trademarks;
• branding; and
• other original content and proprietary materials.

Except for the limited rights expressly granted under the EULA or another written license from G-Presets, no ownership rights in G-Presets intellectual property are transferred to you.

Nothing in these Terms prevents you from independently creating your own photographs, editing styles, techniques, ideas, or creative works that do not copy, redistribute, extract, or improperly derive from protected G-Presets Products or materials.

12. Website Use Restrictions

You may use the Site only for lawful purposes.

You may not:

• attempt to gain unauthorized access to the Site, customer accounts, servers, systems, Products, or data;
• interfere with or disrupt the security or operation of the Site;
• introduce malicious code, viruses, or other harmful technology;
• circumvent access controls, download restrictions, security measures, or digital-delivery controls;
• use automated systems in a manner that materially interferes with the operation of the Site;
• scrape, harvest, crawl, copy, or systematically extract Site or Product content for commercial exploitation, artificial intelligence or machine-learning datasets, competing products, or other unauthorized purposes;
• impersonate another person or misrepresent your identity or affiliation;
• use another person’s account or payment information without authorization;
• misuse promotional, referral, or discount systems;
• use the Site to engage in fraudulent or unlawful activity; or
• use the Site or Products in violation of the EULA.

Ordinary indexing by legitimate public search engines is not prohibited by this section.

13. Accounts

If G-Presets offers customer accounts, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account to the extent reasonably within your control.

You may not sell, transfer, or provide an account to another person for the purpose of giving that person unauthorized access to licensed Products.

Please notify us at help@gpresets.com if you reasonably believe your account has been compromised.

We may take reasonable steps to secure or restrict an account when we detect suspected unauthorized access, fraud, or material violations of these Terms or the EULA.

14. Promotions and Discount Codes

We may occasionally offer promotions, bundles, discounts, referral codes, giveaways, or other special offers.

Additional terms may apply to a particular promotion.

Unless expressly stated otherwise:

• promotional offers have no cash value;
• discounts apply only as described in the applicable offer;
• offers may not be combined where prohibited by the promotion;
• promotions may be changed or discontinued before a qualifying purchase is completed; and
• promotions may not be manipulated, duplicated, or exploited through fraudulent or abusive activity.

If a promotion contains its own terms, those terms will control for that promotion.

15. Reviews, Testimonials, and Feedback

If you voluntarily submit a review, testimonial, comment, suggestion, survey response, photograph, or other feedback to G-Presets, you represent that you have the right to provide it.

You retain ownership of content that you own.

By voluntarily providing a review, testimonial, or feedback for promotional or public-facing use, you grant G-Presets a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and distribute that submitted content for legitimate business, advertising, promotional, and marketing purposes, subject to applicable law.

We will not intentionally alter a testimonial in a manner that materially misrepresents what you communicated.

If separate terms are presented when you submit photographs or other creative material for a particular campaign, contest, collaboration, or promotional project, those separate terms will apply.

16. Third-Party Services and Links

The Site may use, integrate with, or link to third-party websites, platforms, applications, payment services, analytics providers, social networks, digital-delivery systems, or other services.

We do not control third-party services and are not responsible for their independent content, availability, security, terms, or privacy practices.

Your use of a third-party service may be subject to separate terms between you and that provider.

17. Privacy

Our collection, use, disclosure, and protection of personal information is described in the G-Presets Privacy Policy.

We may use cookies and similar technologies as described in that policy and through the privacy and cookie controls available on the Site.

18. Service Availability

We strive to keep the Site and purchased Products reasonably available, but we do not guarantee uninterrupted access.

The Site or portions of it may occasionally be unavailable because of maintenance, technical problems, third-party service outages, security issues, updates, or circumstances beyond our reasonable control.

We may modify, update, replace, or discontinue Site features or Products offered for future purchase.

A Product purchase does not entitle you to future Products, upgrades, additional features, or perpetual updates unless expressly stated at the time of purchase.

19. Product Updates

From time to time, G-Presets may voluntarily provide corrections, revisions, updates, or improvements to a Product.

Unless expressly promised as part of the purchase, we are not obligated to provide updates indefinitely.

Any update provided as part of an existing license remains subject to the applicable EULA unless different terms are expressly provided with the update.

20. Suspension and Termination

We may suspend or terminate access to an account, Site feature, download system, or Product access where we reasonably believe that a person has:

• materially violated these Terms or the EULA;
• engaged in fraud or unauthorized payment activity;
• intentionally redistributed or resold Products without authorization;
• deliberately provided Product access to unlicensed users;
• compromised the security of the Site or another user’s account; or
• used our Site or Products for unlawful purposes.

Where reasonable under the circumstances and where the violation can be corrected, we may provide an opportunity to resolve the issue before permanent termination.

Nothing in this section requires us to continue providing access where immediate action is reasonably necessary to protect G-Presets, our customers, our systems, or our intellectual property.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, licensing, payment obligations, disclaimers, limitations of liability, dispute resolution, and enforcement, will survive.

21. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

G-PRESETS MAKES NO WARRANTY THAT:

• THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, OR ERROR-FREE;
• A PRODUCT WILL BE COMPATIBLE WITH EVERY DEVICE, SOFTWARE VERSION, CAMERA, PROFILE, OR WORKFLOW;
• EVERY PRODUCT WILL CONTINUE TO FUNCTION AFTER FUTURE CHANGES TO THIRD-PARTY SOFTWARE OR TECHNOLOGY;
• EVERY IMAGE WILL ACHIEVE A PARTICULAR EDITING RESULT; OR
• THE SITE OR PRODUCTS WILL MEET EVERY INDIVIDUAL USER’S PARTICULAR BUSINESS OR CREATIVE REQUIREMENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES THAT MAY OTHERWISE APPLY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTIES TO BE DISCLAIMED. NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY, GUARANTEE, OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

22. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, G-PRESETS AND GREG PETERSEN LLC, INCLUDING THEIR MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THIS INCLUDES LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, DATA, FILES, PHOTOGRAPHS, OR OTHER DIGITAL CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF G-PRESETS ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE OR PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO G-PRESETS FOR THE PRODUCT GIVING RISE TO THE CLAIM.

You are responsible for maintaining appropriate backups of photographs, catalogs, project files, and other important data.

Nothing in these Terms excludes or limits liability to the extent that applicable law does not permit that liability to be excluded or limited.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Greg Petersen LLC, G-Presets, and their members, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, and reasonable costs arising directly from:

• your unlawful use of the Site or Products;
• your unauthorized redistribution, resale, sublicensing, or commercial exploitation of Products;
• your infringement of a third party’s rights through content you provide to G-Presets; or
• your material violation of these Terms or the EULA.

This provision does not require you to indemnify G-Presets for claims arising from G-Presets’ own unlawful conduct or to the extent applicable law prohibits such indemnification.

24. International Customers and Mandatory Consumer Rights

G-Presets is based in the United States and makes Products available to customers in multiple countries.

Consumer-protection, digital-content, privacy, warranty, refund, withdrawal, and other laws vary by jurisdiction.

These Terms are not intended to waive or limit any right or remedy that applicable law does not permit you to waive.

If you are entitled to mandatory consumer protections under the laws applicable to you, those protections continue to apply notwithstanding any conflicting provision of these Terms.

Where a provision of these Terms can lawfully be interpreted in a manner consistent with applicable mandatory consumer law, it will be interpreted that way.

25. Compliance With Law

You may not purchase, access, export, re-export, transfer, or use the Site or Products where doing so would violate applicable law.

You are responsible for complying with laws applicable to your use of the Products.

26. Governing Law and Venue

Except where mandatory consumer law provides otherwise, these Terms and disputes arising out of or relating to these Terms, the Site, or the Products are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Subject to any mandatory rights available to you under applicable law, any legal proceeding arising out of or relating to these Terms, the Site, or the Products shall be brought in a state court of competent jurisdiction located in Williamson County, Tennessee, or, where federal jurisdiction exists, in the United States District Court for the Middle District of Tennessee, Nashville Division.

You and G-Presets consent to the personal jurisdiction of those courts for disputes subject to this section.

Nothing in these Terms prevents G-Presets from seeking temporary, preliminary, injunctive, equitable, or other appropriate relief from a court of competent jurisdiction when reasonably necessary to protect intellectual property, proprietary digital Products, accounts, systems, or security.

If you are a consumer located in a jurisdiction whose applicable law gives you mandatory rights concerning governing law, jurisdiction, venue, or dispute resolution, nothing in this section is intended to waive or restrict those rights.

27. Electronic Communications

By placing an order or communicating with us electronically, you consent to receive transaction-related communications electronically, including order confirmations, Product-delivery communications, customer-service messages, security notices, policy notices, and other communications relating to your purchase or account.

Marketing communications are handled separately. Where required, we will send marketing communications only with the appropriate permission, and you may unsubscribe from promotional email using the unsubscribe mechanism provided in those messages.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Products, business practices, technology, or legal obligations.

When we update these Terms, we will post the revised version on the Site and update the effective date.

Changes generally apply prospectively from their effective date.

We will not retroactively revoke material rights already granted under a completed Product purchase except where permitted by the applicable agreement and by law.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

29. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed.

The remaining provisions will continue in effect.

30. No Waiver

If G-Presets does not immediately enforce a provision of these Terms, that does not waive our right to enforce that provision later.

A waiver is effective only with respect to the particular matter for which it is given.

31. Assignment

You may not transfer or assign your rights under these Terms or a Product license to another person except where expressly permitted by the EULA, product-specific terms, or applicable law.

G-Presets may assign these Terms in connection with a merger, acquisition, reorganization, sale of substantially all relevant assets, or similar business transaction, subject to applicable law.

32. Entire Agreement

These Terms, together with the G-Presets EULA, Refund Policy, any applicable product-specific license terms, and any other terms expressly presented and accepted in connection with a particular purchase, constitute the agreement between you and G-Presets concerning the applicable Site use and Product purchase.

Our Privacy Policy describes our privacy practices and should be read together with these Terms.
